Terms of Service

These Terms of Service (“Terms”) govern your access to and use of TinyTalk Kids (“TinyTalk,” “we,” “us,” or “our”), including our website at tinytalkkids.com, mobile applications, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility and accounts

  • Parent or guardian accounts must be created by an adult who is at least 18 years old (or the age of majority in their jurisdiction).
  • Child accounts may only be created and managed by a linked parent or guardian account.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You agree to provide accurate information and to keep it up to date.

2. Description of the Service

TinyTalk Kids provides a private family communication platform that may include messaging, emoji and photo sharing, homework features, push notifications, AI-assisted replies, and daily emotional or activity reports. Features may change over time, including during beta periods.

3. Parental responsibility

Parents and guardians are responsible for supervising their child’s use of the Service, configuring permissions, reviewing content, and deciding whether AI-assisted features are appropriate for their family. TinyTalk is a tool to support communication and does not provide medical, psychological, legal, or emergency services.

4. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, abusive, or harassing purposes.
  • Upload content that infringes intellectual property or privacy rights of others.
  • Attempt to access accounts or data that do not belong to your family.
  • Reverse engineer, scrape, or interfere with the Service’s security or operation.
  • Use the Service to send spam, malware, or unauthorized commercial messages.

5. User content

You retain ownership of content you or your child submit (“User Content”). You grant TinyTalk a limited license to host, store, process, and display User Content solely to operate and improve the Service, including AI-assisted features you enable. You represent that you have the rights necessary to submit User Content.

6. AI features

AI-generated responses, summaries, and reports are provided for informational and assistive purposes only. They may be incomplete or inaccurate. You should not rely on AI outputs for critical decisions regarding a child’s health, safety, or welfare. Parents may enable, disable, or adjust AI features where available.

7. Fees and subscriptions

Some features may be free during beta. Paid plans, credits, or subscriptions may be introduced or changed with notice. Fees are non-refundable except where required by law or expressly stated in a separate refund policy.

8. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

9. Intellectual property

The Service, including software, design, logos, and documentation, is owned by TinyTalk or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or brand except as needed to use the Service.

10. Suspension and termination

We may suspend or terminate access to the Service if you violate these Terms, create risk or legal exposure for us, or if we discontinue the Service. You may stop using the Service at any time and may request account deletion through account settings or support.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINYTALK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINYTALK AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $100.

13. Indemnification

You agree to indemnify and hold harmless TinyTalk from claims arising out of your misuse of the Service, your User Content, or your violation of these Terms or applicable law.

14. Governing law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country provide otherwise.

15. Changes to these Terms

We may modify these Terms from time to time. If changes are material, we will provide notice through the Service or by email. Continued use after the effective date constitutes acceptance of the updated Terms.
